The Government's Standard Contracts makes it easier to negotiate contracts for IT services.

K02 - standard contract for long-term IT projects

The contract, known as K02, has been circulated for technical consultation up to 1 October 2007, when it has been possible to point out any specific errors or omissions. Work is now in progress to incorporate the comments from the technical consultation. The contract is expected to be ready by November 2007.

K02's scope of application has been defined as development and implementation projects of a certain magnitude, which will typically be characterised by the following:

  • A significant economic extent, which is beyond the tendering limit.
  • A timescale exceeding six months.
  • High technical and organisational complexity.
  • A high degree of customisation.
  • Services are included to a not insignificant extent.
  • The overall system is assumed to be delivered and implemented as a number of phased deliveries.

In cooperation with the Danish IT Industry Association, the Danish IT Society and the Legal Adviser to the Government, a so-called agreed document has been prepared, in the form of a standard contract backed up both by the Danish IT Industry Association and the Danish IT Society.

New features in K02 include: 

  • Introduction of requirements for maturity, to be met both by the customer and the supplier. Greater maturity in IT project management aims to obviate major IT scandals in public authorities. A number of models are used for maturity measurement, developed by the Ministry of Science, Technology and Innovation in cooperation with the Danish IT Society, ITEK/Confederation of Danish Industries, the Danish Management Board, the Danish IT Industry Association, Local Government Denmark and Danish Regions. The model was launched in the spring of 2006.
  • Right for other public authorities to utilise customised software. The contract allows other public authorities, both government, regional and local, to utilise customised software developed for the customer. At the same time, it is possible for private enterprises to earn money on reselling customised software to private enterprises and to customers abroad.
  • Increased requirements for documentation supporting a real choice of supplies. The contract includes extended requirements for the level of documentation and access to the supplier's development tools.

K01 - standard contract for short-term IT projects

The standard contract for short-term IT projects, known as K01, has been prepared by a working group under the Ministry of Science, Technology and Innovation, with representatives from the Ministry (chairman), the Danish Agency for Governmental Management, the Legal Adviser to the Government, the Danish IT Society, and the Danish IT Industry Association. The contract, intended for IT procurement in the government sector, is part of a contract package which also includes nine model appendices and a guide.

The overall contract package results from a dialogue between the parties involved and has, by virtue of this, assumed the character of a negotiated standard (agreed document).

The purpose of K01 is to replace the use of a standard contract for standardised computer systems, known as K18, dating from 1992. K01 is intended for delivery of standard products for which customisation etc. is relevant only to a limited extent. Efforts have been made to design the contract in such a manner that it will meet the needs of government institutions in connection with modern IT procurement to the greatest possible extent.

Standard cooperation agreement

In cooperation with the Agency for Governmental Management and the Ministry of Science, Technology and Innovation, the Legal Adviser to the Government has prepared a standard cooperation agreement to be used for regulating collaboration between a government institution, an IT consultant and the Legal Adviser to the Government on IT procurement.

The standard cooperation agreement with the associated guide and appendix is an offer to government institutions if they are to procure IT equipment where both the Legal Adviser to the Government and an IT consultant act as advisors.

The cooperation agreement sets a framework for this tripartite relationship, so that responsibilities and tasks are clearly defined.

The guide to the cooperation agreement includes an appendix containing a draft time schedule and activity plan that may be used as a reference even if the cooperation agreement is not used.
